Federal judge: Niles can't be liable for officer's actions

A federal appeals court has ruled the city of Niles can't be held liable for the actions of a former police officer.

Ivery Cross pleaded guilty to criminal sexual conduct. He admitted to sexually abusing a 19-year old who he had arrested on drug charges.

Cross admitted to forcing him to remove his clothes and perform sex acts in the police department. The victim filed a lawsuit against Cross, the police chief and five Michigan state troopers.

A federal appeals court, however, upheld a lower court's ruling the city isn't responsible.
